Terms of Service

These Terms of Service ("Terms") govern your use of Thirdraft ("we", "us"), including the Chrome extension, the web app at thirdraft.com/app and this website (together, the "Service"). By using the Service, you agree to these Terms. If you don't agree, please don't use it.
1. Eligibility
You must be at least 13 years old to use Thirdraft.
2. Your account
You sign in with your email address. Keep access to that inbox secure: you're responsible for everything that happens under your account. Tell us at support@thirdraft.com if you think someone else has used it.
3. Plans and billing
- Free plan. Includes a limited number of rewrites and writing samples, as listed on our pricing page. We may change what the free plan includes.
- Personal plan. $10 per month, billed in advance through Stripe. Taxes may be added where required.
- Automatic renewal. Your subscription renews every month and your payment method is charged until you cancel.
- Canceling. Cancel any time from Manage subscription in the extension or web app. Your plan stays active until the end of the period you've paid for, then won't renew.
- Refunds. Payments are non-refundable, as set out in our Refund & Cancellation Policy.
- Price changes. If we change the price, we'll email you at least 14 days before it applies to your next renewal, so you have time to cancel.
- Failed payments. If a payment fails, your plan may be paused or moved to the free plan until it's resolved.
4. Your content
You own the writing you give Thirdraft, including your samples and the text you rewrite (together, "Your Content"). You also own the rewrites Thirdraft produces for you.
So that we can run the Service, you give us a limited, non-exclusive, worldwide license to store, process and transmit Your Content, only to provide Thirdraft to you. That includes sending it to the service providers listed in our Privacy Policy. We don't use Your Content to train AI models. The license ends when you delete Your Content or your account.
You're responsible for Your Content. Only add writing you have the right to use, and don't use Thirdraft on content that breaks the law or someone else's rights.
5. AI-generated rewrites
Rewrites are produced by an AI model and can be wrong. A rewrite may change your meaning, leave out details or introduce mistakes. Always read a rewrite before you send or publish it. You're responsible for what you send.
6. Acceptable use
You agree not to:
- use Thirdraft for anything illegal, fraudulent or harassing;
- use it to create spam, to impersonate someone else, or to deceive people in ways that harm them;
- try to get around usage limits or payments, for example by creating accounts to reset the free plan;
- interfere with, overload, reverse engineer or scrape the Service, or access it except through the extension, the web app or ways we've approved; or
- resell or give others access to the Service without our written permission.
7. Suspension and termination
You can stop using Thirdraft and ask us to delete your account at any time (see the Privacy Policy). We may suspend or close accounts that break these Terms or put the Service or other users at risk. Where reasonable, we'll tell you first. If we close a paid account for reasons other than a breach of these Terms, we'll refund the unused part of your current billing period.
8. Changes to the Service
We're a small product and will keep improving Thirdraft, which means features may change or be removed. If we shut the Service down, we'll give account holders at least 30 days' notice and refund any unused part of a prepaid period.
9. Third-party services
Thirdraft works inside other services, such as Gmail, and relies on providers such as Stripe and OpenAI. We aren't responsible for those services, and your use of them follows their own terms.
10. Disclaimer
The Service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We don't promise the Service will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and US $50. Some places don't allow these limits, so they may not all apply to you.
12. Indemnity
If someone brings a claim against us because of Your Content or your breach of these Terms, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
13. Governing law
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts in New York, unless the law where you live gives you the right to bring it there.
14. Changes to these Terms
We may update these Terms. We'll change the date at the top, and we'll email account holders about significant changes before they take effect. If you keep using Thirdraft after that, you accept the new Terms.
